AGREEMENT TO TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and PromolinTech Technologies Software ("Company," "we," "us," or "our"). This agreement governs your access to and use of the website located at www.promolintech.com, including any related media, mobile sites, and applications (collectively, the "Site"). By using the Site, you agree to these Terms. If you do not agree to all of these Terms, you are prohibited from using the Site and must immediately cease all use.

We reserve the right to modify these Terms at our discretion, and any changes will be reflected by updating the "Last Updated" date. You are responsible for reviewing these Terms regularly. • Sell or transfer your Site profile to another party.

USER GENERATED CONTRIBUTIONS

The Site may allow you to chat, contribute, or participate in blogs, forums, and other platforms, and create or share content ("Contributions"), including text, videos, audio, graphics, and comments. Contributions may be visible to other users and third-party websites. By submitting Contributions, you represent and warrant that:

• Your Contributions do not infringe on any third-party copyrights, patents, trademarks, or intellectual property rights.
• You own or have the necessary rights and permissions to share your Contributions.
• You have written consent from every identifiable person in your Contributions.
• Your Contributions are not false, misleading, or deceptive.
• Your Contributions are not unsolicited advertisements, spam, or pyramid schemes.
• Your Contributions are not obscene, harassing, or otherwise inappropriate.
• Your Contributions do not ridicule, threaten, or abuse others.
• Your Contributions comply with all applicable laws and regulations.
• Your Contributions do not violate privacy or publicity rights.
• Your Contributions do not include offensive content related to race, gender, or disability.
• Your Contributions do not violate child protection laws.
• Your Contributions do not link to illegal or prohibited material.

Any violation of these Terms may result in suspension or termination of your access to the Site.

CONTRIBUTION LICENSE

By posting your Contributions on any part of the Site, you automatically grant, and you represent and warrant that you have the right to grant, us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide license to:

• Host, use, copy, reproduce, disclose, sell, resell, publish, broadcast, retitle, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, and distribute your Contributions.
• Prepare derivative works or incorporate them into other works.
• Grant sublicenses for the above rights.

This license applies to any media format or technology, now known or developed in the future, and includes the use of your name, company name, franchise name, trademarks, logos, and personal images you provide. You waive all moral rights in your Contributions and warrant that no moral rights have been asserted in them.

We do not claim ownership of your Contributions. You retain full ownership of your Contributions, including intellectual property rights. However, you are solely responsible for your Contributions and agree to hold us harmless from any legal claims related to them.

We reserve the right, at our sole discretion, to:

• Edit, redact, or change Contributions.
• Re-categorize Contributions for better organization.
• Pre-screen or delete Contributions without notice.

We have no obligation to monitor user Contributions.

SUBMISSIONS

Any questions, comments, suggestions, ideas, feedback, or other information submitted to us regarding the Site ("Submissions") are deemed non-confidential and become our sole property. We hold exclusive rights, including intellectual property rights, over Submissions and may use them for any purpose without acknowledgment or compensation.

You waive all moral rights to Submissions and warrant that they are original or that you have the right to submit them. You agree that there will be no recourse against us for any alleged infringement or misuse of Submissions.

WE MAY TERMINATE YOUR USE OR PARTICIPATION IN THE SITE OR DELETE ANY CONTENT OR INFORMATION THAT YOU POSTED AT ANY TIME WITHOUT WARNING IN OUR SOLE DISCRETION.

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to pursue appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

GOVERNING LAW

These Terms shall be governed by and defined following the laws of India. Promolintech Software and yourself irrevocably consent that the courts of India shall have exclusive jurisdiction to resolve any dispute arising in connection with these terms.

DISPUTE RESOLUTION

Informal Negotiations

To expedite resolution and control the cost of any dispute related to these Terms of Use, the Parties agree to first attempt to negotiate any dispute informally for at least thirty (30) days before initiating arbitration.

Binding Arbitration

Any dispute arising out of or in connection with this contract, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration under the rules of the International Commercial Arbitration Court.

Restrictions

Arbitration shall be limited to the dispute between the Parties individually. No arbitration shall be joined with any other proceeding, and class-action procedures are not permitted.

Exceptions to Informal Negotiations and Arbitration

Disputes concerning intellectual property rights, theft, privacy invasion, or unauthorized use are exempt from arbitration and may proceed in court.

CORRECTIONS

We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Site at any time without prior notice.

DISCLAIMER

The Site is provided on an "as-is" and "as-available" basis. You agree that your use of the Site and our services will be at your sole risk. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

INDEMNIFICATION
